Background

The applicant shot the victim with a gun that had been stored in the attic of their home. The applicant was convicted of second degree murder and given a life sentence without parole eligibility for 10 years.

SDR Evidence

The applicant provided the SDR with new information that the victim had sexually assaulted her on the day of the killing. She told the SDR that she went to the attic, retrieved a gun, loaded it and shot her victim because of that assault. The SDR concluded that this information was reasonably capable of belief, that the victim had assaulted the applicant and that she feared she would be assaulted again. While the SDR concluded the degree of force used by the applicant was excessive in the circumstances, it also found that the victim's wrongful acts would provoke an ordinary person who shared the applicant's background and circumstances to lose self-control. The SDR concluded that the applicant's new information concerning the victim's behaviour on the day of the killing was credible and would have resulted in a finding of provocation by a reasonable trier of fact. Therefore, the SDR concluded that the applicant would have been convicted not of second degree murder, but of manslaughter. The SDR recommended commutation of the applicant's sentence, or the remission of the remainder of her life sentence, with aftercare for one year.

Trial Evidence

Self-defence was not raised at trial or on appeal. The applicant testified at trial that she and her victim had been drinking and she had no memory of the shooting. Relations between the victim and the applicant were marked by tension, but no violence, prior to the shooting. The applicant's new information is inconsistent with previous information provided by the applicant to the police or her counsel, and through her trial testimony. In earlier accounts, the applicant claimed that the killing was strictly accidental.

I think what Agurus nearly means is that people should own a gun for their self-defense, seeing that it is the 2nd Amendment.

Shooting someone down outside of your house or property, however, charges murder on you. But, if they're inside your house, you won't be charged since they'll recognize it at self-defense.

Thank you my point exactly. And Donkano, a weapon could save your life in a life threatning situation, it is always useful for just in case you will need it.

I perfer my katana under my bed. More fun to use out in the public than a gun, because it seems that shooting stuff attracts cops. Slicing the hell out of everything attracts observers.

Ya... good luck trying to hide a katana. A short sword would be more easy to conceal.

Bah, you just have no watched Highlander nearly enough. Even the shortest coat can hid a huge sword, and no one ever looks for someone carrying a sword.

I mean if you really think about it who doesent have some kind of weapon in thier house? We have about 5+ guns in are house. Well be go hunting so thats mainly why but we have about 3 loaded.

In my house the deadliest weapon would be a steak knife.

I don't live ina world full of fear. Only possible CONSERN I have right now is the Avian Flu, and I am not even worried about that. History has proven that all this stuff is just scare tactics that are influenced by politicians and spread by media.

Agurus, this topic is really mean.. you should really be ashamed of yourself. Hes obviously in need. The hurricane did do alot of damage and there were looters.. Looks to me like you have just as little a life as you claim he does.. Think about it. Atleast hes doing something sensible and sending out a message for some help. You on the other hand is sitting around on a forum laughing at something you dont care about. I feel kinda sorry for psy.. I might donate some.. not a lot.. but mabye some that I can spare. If its a scam, then he will pay dearly later on, but thats none of my business.. All Im saying is that its people like you that get bit in the ass, Agurus.
