My old 42 inch tv has a bottle in it, I haven't even taken the tv off to the dumpster yet. I have none of my work from the past 5 years of continuum and all other projects I had going on. My backups that were in my cd cases were stolen aswell as my computer and alot of computers I was working on. I have yet to even get some of my basics back, for instance I still have no phone yet I do have a phone line. I have no microwave but I have food I could cook in it. No couch, no tv and im on a p1 166mhz that I made out of trash I had in my closet. Just a day ago I was able to get an air mattress before that I was sleeping on the floor. I've been using my oven but they did something with most of my pots and pans. I have food and have managed to get rent paid for but I have to somehow get new furniture and basicly all things for my apartment. I now actually owe people money for the computers I had at my house that have been stolen. I have no real way of making the money because I do not have all the tools I used to have. As you all know I haven't had a legit job in years I've always just bootlegged and rebuilt computers. I basicly got robbed for my entire home buisness and all my belongings. SDR - 37 Conviction: Second Degree Murder Length Of Sentence: Life Sentence Present Status: On Full Parole Background The applicant shot the victim with a gun that had been stored in the attic of their home. The applicant was convicted of second degree murder and given a life sentence without parole eligibility for 10 years. SDR Evidence The applicant provided the SDR with new information that the victim had sexually assaulted her on the day of the killing. She told the SDR that she went to the attic, retrieved a gun, loaded it and shot her victim because of that assault. The SDR concluded that this information was reasonably capable of belief, that the victim had assaulted the applicant and that she feared she would be assaulted again. While the SDR concluded the degree of force used by the applicant was excessive in the circumstances, it also found that the victim's wrongful acts would provoke an ordinary person who shared the applicant's background and circumstances to lose self-control. The SDR concluded that the applicant's new information concerning the victim's behaviour on the day of the killing was credible and would have resulted in a finding of provocation by a reasonable trier of fact. Therefore, the SDR concluded that the applicant would have been convicted not of second degree murder, but of manslaughter. The SDR recommended commutation of the applicant's sentence, or the remission of the remainder of her life sentence, with aftercare for one year. Trial Evidence Self-defence was not raised at trial or on appeal. The applicant testified at trial that she and her victim had been drinking and she had no memory of the shooting. Relations between the victim and the applicant were marked by tension, but no violence, prior to the shooting. The applicant's new information is inconsistent with previous information provided by the applicant to the police or her counsel, and through her trial testimony. In earlier accounts, the applicant claimed that the killing was strictly accidental. |
